The Court of Appeal has nullified the judgment of the Federal High Court that ordered the Independent National Electoral Commission, INEC, to deregister the ADC and four other political parties.
The judgment was delivered after a 3-member panel of the Court of Appeal, led by Justice Abba Mohammed, ruled that the Federal High Court did not have jurisdiction to hear the case in the first place. Because of that, the judgment it delivered is invalid.
The Court also stated that the Federal High Court erred by going ahead to deliver judgment despite the Court of Appeal’s order to stay further proceedings in the case.
In addition, the Court said the person who filed the suit did not have the legal right to do so.
Aside from the ADC, the other parties affected by the nullified judgment are Accord Party, AA, APP, and ZLP. This means the order directing INEC to deregister them now has no effect.
